Where a building abuts another parcel with a difference in vertical elevation of three feet or more, the required side and/or rear setback shall be measured from the nearest toe or top of slope to the structure, whichever is closer; provided that the distance from the base of the structure to the toe of the slope shall be at least five feet (See Figure 3-9)
